    NZ Median Wage Rise – Impact on Visa Categories

    Minimum wage is the lowest remuneration that employers can legally pay their employees. Median wage refers to the borderline between the highest and lowest pay of workers in a specific position or occupation.

    As of 19 July 2021, the New Zealand median wage is NZD $27 an hour. The median wage has a big impact on Employer Assisted Work Visa holders as well as for Residence Visas under the Skills Migrant Category (SMC).

    Impact on Employer Assisted Work Visas

    Whether a worker is paid below, equal to or above the median wage will determine the duration of the visa, the maximum time he / she can hold an essential skill visa, ability to support a partner or the need to leave New Zealand for 12 months after holding a 3 years visa (aka stand down period).
    If your Essential Skills Work Visa (ESWV) was lodged on or after 27 July 2020 and you are paid equal to or above the median wage, you can support

    • a work or visitor visa for your partner
    • a visitor or student visa

    You would be eligible for a 3 years visa.

    If your essential skills work visa was lodged on or after 27 July 2020 and you are paid below the median wage, you can support

    • a visitor visa for your partner
    • a visitor or student visa for your dependent children provided you meet the minimum income requirement of NZ$ 43322.76 per annum.

    If you are granted a visa on or from 19 July 2021, the maximum duration of your visa will be 2 years.

    Impact on Residence Visas under the Skills Migrant Category (SMC)

    For skill level 1, 2 and 3 occupations, the employer needs to pay the employee a minimum of NZ $ 27 per hour. For skill level 4 and 5 occupations, the employer needs to pay at least NZ$ 40.50 per hour to considered for Residence visa.

    An applicant can claim bonus points for high remuneration if they are earning NZ$54 per hour or above (or the equivalent annual salary).

    The tuition fees for international students for the NZ Certificate in Health and Wellbeing courses at Levels 2, 3 and 4 range from $2000 NZD to $10000 NZD. The fees for Levels 7, 8 or 9 is higher.

    If you already have an overseas qualification related to aged care, check if it is recognized by the sector. Roles listed on New Zealand’s Long Term Skills Shortage List must be comparable to the standard of the New Zealand qualification on the list.

    UNDERSTANDING CHARACTER REQUIREMENTS AND CHARACTER WAIVER REQUEST – IMMIGRATION NEW ZEALAND

    Character is one of the most critical assessment criteria that anyone applying for a New Zealand visa or entry permission must meet. Essentially what it means is that the applicant must be of good character, not pose a security risk and not threaten New Zealand’s international reputation.

    People with serious character issues can’t be granted any visa or entry permission, except in very special circumstances.

    Character check is carried out on everyone who is 17 years or over included in the residence visa or applying for a temporary visa with an intention to stay in NZ for two years or more.

    For character checks, an applicant must provide a Police Clearance Certificate (PCC) from the country of citizenship and any country where he/she has lived for more than five years since turning 17 years of age. It is important to note that a police certificate must be less than six months old when lodging an application.

    Two criteria generally guide the character requirement:

    • Applicants who will NOT be issued with a temporary or residence class visa unless a Special Direction is granted; and

    • Applicants who will NOT normally be issued with a temporary or residence class visa unless a Character Waiver is granted by the visa officer processing their visa.

    Not issued temporary or residence class visa unless special direction granted

    An applicant will not be granted a visa if

    • there has been a conviction on an offense for which the applicant was sentenced to imprisonment of five years or more; or

    • there has been a conviction in the last ten years on an offense for which the applicant was sentenced to imprisonment of 12 months or longer; or

    • the applicant is prohibited from entering New Zealand; or

    • the applicant has been removed, deported, or excluded from New Zealand; or

    • has ever been removed, excluded, or deported from any country.

    The applicant will also not be granted a visa if the Immigration officer has reason to believe that:

    • the applicant is likely to commit an offense in New Zealand that is punishable by imprisonment, or

    • is likely to be a risk to the security or a threat to public order or public interest.

    These are considered serious character concerns, making an applicant ineligible to be granted a visa unless granted a Special Direction.

    Not issued temporary or residence class visa unless character waiver is granted

    Character issues for which an applicant may require a character waiver are:

    • if the applicant has ever made or provided false or misleading information, or withheld material information, or provided forged documents when applying for a New Zealand visa or supporting another person’s NZ visa application.

    • if the applicant has ever got convicted of an offense against immigration, citizenship, or passport laws in any country.

    • while holding a temporary New Zealand visa or while unlawfully in New Zealand, the applicant has been convicted of an offense for which the court has the power to imprison you for three months or longer.

    • if the applicant has been charged with a serious offense, is under investigation for a serious offense, or is wanted for questioning on a serious offense.

    Suppose you do not meet any of the above criteria. In charged with a serious offense that case, you should provide a full explanation about the character issue, with supporting evidence when you apply for a New Zealand visa.

    The Immigration officer will use this information to consider a Character Waiver or grant a Special Direction based on the seriousness of the character concern.

    Eligibility Criteria

    Immigration New Zealand instruction states that you may be eligible for the partnership-based visa if

    • your New Zealand partner is eligible to support your application; and

    Partnership- based Visa categories

    Culturally Arrange marriage – Temporary visitor visa

Based on the duration of your relationship/living together, you would be eligible for a visitor or work visa.

    Partner of New Zealander – Resident Visa (Onshore and offshore applicants)

    This requires you and your New Zealand partner to be living together in a genuine and stable relationship for at least twelve months at the time of lodgement of your application. You are required to provide documentary evidence for a minimum of 12 months to show that you meet the living together requirement.

    Critical Purpose Visitor Visa (Border exemption) Offshore applicants

    As per the criteria, citizens of ‘visa waiver’ countries are mandated to meet few policies, including living together in genuine and stable relationship criteria. For the ‘non-visa waiver’ countries the applicants should be ordinarily resident in New Zealand or traveling with their New Zealand partners.

    New Zealand Border Exception Criteria For Partners And Dependents Of Citizens/Residents

    Do you wish to enter New Zealand? If the answer is yes, you must be aware of the options Immigration New Zealand (INZ) has for you.

    Even though the borders are currently closed for most travellers, partners of New Zealand citizens/residents can travel to New Zealand if they hold a critical purpose visitor visa or relationship-based visa. As you would already know, entry to New Zealand from all countries remains strictly controlled to prevent the spread of COVID-19.

    Partners of New Zealand resident/citizen who are currently outside New Zealand

    Those applicants who do not hold a relationship-based visa and are currently outside New Zealand can apply for a border exception.

    However, to do that under this category and criteria, you must prove that you are in a genuine and stable relationship and intend to travel to New Zealand with your New Zealand partner(citizen/resident). You can include even dependent children in the application.

    Border Exception Process

    The first step is to request a border exception called an Expression of Interest (EOI) by INZ. This EOI is not a visa application but a request form that only lets you explain your circumstances in 3000 words. There is no option to upload any documents, and you have to explain in limited words how you think you meet the relevant immigration instructions to qualify for a border exception. The fee for this request is NZD 45 as of date.

    If INZ is satisfied that you meet the requirements based on the information provided in the request form, they will issue an ‘Invitation to Apply (ITA)’ for a Critical Purpose Visitor Visa (CPVV). This will be an actual visa application wherein you will be requested to lodge a formal application and submit the relevant supporting documentary evidence to prove that you live together in a genuine and stable relationship with a New Zealand resident/citizen. The fee for this application is NZD 246. If the CPVV is approved, you can travel to NZ with your partner.

    Partners or dependents of a New Zealand citizen or resident ordinarily residents in New Zealand but do not have a relationship-based visa can also request border exception. If their request is approved, they will then be invited to apply for a visitor visa, another visa that suits their circumstances or to vary their existing visa to allow them to travel. The process remains the same as explained above, and you would need to demonstrate that you are in a genuine and stable relationship with your New Zealand partner(citizen/resident). The only difference here is that the NZ partner does not need to accompany the applicant.

    Partners or dependents of a New Zealand citizen/resident currently out of New Zealand but have a valid partnership-based visa or dependent visa.

    Those applicants will be able to travel on that visa. There is no need to apply for a border exception, nor are they required to travel along with the NZ partner.

    Note – the process varies slightly for applicants who are Australian citizens/residents.

    Reasons for not receiving an ITA:

    • INZ is not satisfied that you are in a genuine relationship with an NZ citizen/resident.
    • There are outstanding bona fides/Character issues/Health issues.
    • INZ has identified bona fides/Character issues/Health issues in the border exception request.

    This process may appear to be straightforward; however, it involves a lot of intricacies. There are many complexities involved in determining if you may be eligible to travel to New Zealand during the current border closure. The threshold is very high to be granted a border exception/relationship-based visa. The onus lies on the applicant to satisfy the Immigration Officer that he/she meets the relevant instructions. The Immigration Officer is not obliged to seek further information/documentation and decide the application based on the information on hand.
